Terms of Service

The agreement for using Duoniva, a private iPhone app for two adults who are already partners.
1. The agreement
These terms are a contract between you and Nubesti LLC for Duoniva, including the iPhone app, duoniva.com, and api.duoniva.com. Duoniva is coming soon. Creating an account, or using the app after it is available, means you accept these terms and the Privacy policy.
If you use Duoniva for a couple, you do so for yourself. You do not accept these terms on behalf of your partner. Each person needs their own account.
2. Who Duoniva is for
Duoniva is for two adults, 18 or older, who are already partners. It is not a dating app, a matching service, or a public social network. It is not therapy, medical care, or legal advice.
The company is in the United States. People in other countries may use Duoniva when it is available, as long as they can do so lawfully where they are. You are responsible for that local use.
3. Accounts
An account can be created with email and a password, or with Sign in with Apple. Keep the sign-in method yours. Tell us at hello@duoniva.com if you believe someone else is using your account.
We may refuse, suspend, or close an account that breaks these terms, harms another person, or creates a security risk. We will explain the reason when we can do so without creating a further risk.
4. The shared space
A Duoniva space belongs to one couple. Connecting does not give either person automatic access to everything the other does. Sharing a memory, plan, or other item is a choice.
Private message text is sealed on the device. We store ciphertext, not the readable message. Photos, albums, milestones, time capsules, and calendar items placed in the shared story are stored so both of you can open them. Those story files are not end-to-end encrypted.
5. Your content
You keep ownership of the content you add. You give Nubesti LLC a limited permission to host, transmit, back up, and display that content only so we can operate Duoniva for the two people in the space. This permission ends when the content is deleted, except for copies that remain in backups until they age out, and except for content your partner already has in the shared space.
You will only upload content you have the right to share. You will not upload another person's intimate images, or anyone's content, without their consent.
6. Acceptable use
- Do not use Duoniva if you are under 18.
- Do not harass, threaten, stalk, or impersonate anyone.
- Do not upload illegal content, including sexual content involving anyone under 18.
- Do not try to break into another couple's space, another account, or the service.
- Do not scrape, resell, or misuse invitation codes, session tokens, or other people's data.
- Do not use the service to send malware or to overload the system.
7. Subscriptions, privacy, and ending use
Paid plans are described in Billing & subscriptions and Refunds & cancellation. They are not on sale yet. Prices shown on the marketing site for design purposes are not an offer.
The Privacy policy explains the data we handle. Account & data deletion explains how to ask for deletion. You may stop using Duoniva at any time.
8. Changes, warranties, and liability
We may change the service or these terms. If a change is material, we will post the new date on the legal center and, when we have your email, tell you before the change applies to you. If you keep using Duoniva after that, the new terms apply. Local law may give you the right to stop using the service instead.
Duoniva is provided as available. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or that every message or photo will always be recoverable. A new phone cannot open older sealed messages with the current design.
To the extent the law allows, Nubesti LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for a claim about Duoniva is limited to the amount you paid us for Duoniva in the 12 months before the claim, or 50 US dollars if you paid nothing. This limit does not apply to liability that cannot be limited, including fraud, or death or personal injury caused by negligence where the law forbids that limit.
9. Disputes and law
Write to hello@duoniva.com first and give us a chance to resolve the problem. These terms are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to conflict-of-law rules.
Courts in Delaware may hear a dispute, except where a consumer-protection law where you live requires a local court or forbids that choice. Rights you have as a consumer in the European Economic Area, the United Kingdom, or your US state, when those rights cannot be waived, stay in place.
